1. ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF USE

Your use of RGB EasyWeb indicates your agreement to the RGB EasyWeb Terms of Use laid out below and acknowledgment of the RGB EasyWeb Legal Statements. These documents may be modified without prior notice provided that the terms regarding the introduction of paid services are not altered without timely notification of all users. User's continued use of the service constitutes an affirmative acknowledgment by user of these modifications.

The most current version of The Terms of Use and Legal Statements will always reside online at http://rgbeasyweb.com. The RGB EasyWeb Terms of Use and RGB EasyWeb Legal Statements comprise the entire agreement between the users and RGB Internet Systems, Inc., unless otherwise indicated.

2. DESCRIPTION OF SERVICE. MODIFICATIONS TO SERVICE
RGB EasyWeb provides users with various web publishing and content management services, including but not limited to the ability to create and maintain a web page as well as the hosting services for this webpage. In order to use the service users should provide for own access to internet and pay any service fees associated with such access.

RGB EasyWeb reserves the right to change the terms of service and prices for paid upgrades without prior notification.

RGB EasyWeb reserves the right to delete free accounts, which have not been used for a certain period of time, following an email notification and the expiration of the warning period defined therein.

3. USERS OBLIGATIONS AND CONDUCT
Each user bears the sole responsibility for the content published on their RGB EasyWeb website. RGB Internet Systems, Inc. does not control the content posted via the service and, as such, does not guarantee the accuracy or quality of such content and cannot be held responsible for it. Use of the service is subject to all applicable local, state, national and international laws and regulations as well as to internet-specific policies and procedures.

User agrees:
(i) not to use the service for illegal purposes;
(ii) not to publish any material that is unlawful, harassing, abusive, threatening, offensive, vulgar, obscene, harmful, libelous, invasive of another's privacy or constitutes an infringement of third party intellectual property rights.
(iii) not to interfere with or disrupt in any way the service including servers and networks connected to the service;
(iv) not to interfere with another user's enjoyment of the service.
User should indemnify and hold RGB Internet Systems, Inc. and their subsidiaries, affiliates, officers and employees, harmless from any claim or demand made by any third party due to or arising out of user's conduct, violation of these Terms of Use by user, or the infringement by user of any intellectual property or other right of any person or entity.
RGB Internet Systems, Inc. may, at their sole discretion, terminate the service should a user's conduct fail to conform to these terms and conditions.
 
4. USER ACCOUNTS AND SECURITY
Users are entirely responsible if they do not maintain the confidentiality of their password and account, as well as of password protected areas of their sites. Users are entirely responsible for any and all activities which occur under their account.
Users agree to immediately notify RGB Internet Systems Inc. of any unauthorized use of their account or any other breach of security known to user.
 
5. CONTENT OWNERSHIP
Users retain copyright ownership and all related rights for materials published on their RGB EasyWeb website.

6. STORAGE AND OTHER LIMITATIONS
RGB Internet Systems Inc. reserves the right to automatically clean assets exceeding the storage limit, after sending an email notification for exceeding the limit and failure on the part of the user to take subsequent action to clean the surplus assets or alternatively request an upgrade of the account. RGB Internet Systems Inc. assumes no responsibility for the deletion or failure to store information entered into RGB EasyWeb.
 
7. NOTICE AND TERMINATION OF SERVICE

Either RGB Internet Systems Inc. or the user may terminate use of the Service with or without cause at any time and effective immediately. RGB Internet Systems Inc. shall not be liable to users or any third party for termination of the service. Upon termination, user's right to use the service and the related software ceases immediately.

8. Third Parties

RGB Internet Systems, Inc. maintains a minimum of 99.99% uptime for websites and email.  However, RGB Internet Systems, Inc. can take no responsibility for services provided by third parties through us or otherwise. RGB Internet Systems, Inc. can take no responsibility for information posted on a website which we host. It is the user's responsibility to keep the online terms and conditions of the website up to date.

9. Maintenance and Correction of Errors

Errors (both technical and typographical) attributable to RGB Internet Systems, Inc. will be corrected free of charge, but RGB Internet Systems, Inc. reserves the right to charge a reasonable fee for correction of errors for which RGB Internet Systems, Inc. is not responsible, including, but not limited to malicious modifications of the Website by a third party, accidental loss of information by client which needs to be restored  and typographical errors contained in materials provided to RGB Internet Systems, Inc. by the user.

10. Consequential Loss

Under no circumstances will RGB Internet Systems, Inc. be responsible or liable for financial or other loss or damage caused by the failure or use or misuse of its software. 

11. Status and Duration of Offers

Proposals and offers are valid for a period of one month from the date issued. RGB Internet Systems, Inc. is not bound to honour offers that have expired.  Offers are not legally binding until an acceptable timetable for the work has been agreed by both parties.  This timetable must be agreed within the month that the offer is valid.  If an acceptable timetable has not been approved by both parties within one month of the offer being made, the offer is deemed to have expired.

12. Search Engine Listings

RGB Internet Systems does not guarantee listings on Search Engines and the Client accepts that it is Search Engines and not RGB Internet Systems, Inc. who determine whom they list and whom they will not.  The User further understands there is no guaranteed placement or rank on the Search Engines and that a new website may never even appear on Search Engines at all.  RGB Internet Systems, Inc. does not control Search Engines’ algorithms and huge shifts can appear daily, weekly and even hourly.

13. Cross Browser Compatibility
Our agreement contemplates the creation of a web site viewable by both Firefox 1.5 to 2.0 and Microsoft Internet Explorer 6.0 to 7.0. Compatibility is defined herein as all critical elements of each page being viewable in both browsers. User is aware that some advanced techniques with programming for the Internet may be used, and  may require a more recent browser version and brand or plug-in. User is also aware that as new browser versions of Internet Explorer and Firefox are developed, the new browser versions may not be compatible. In the absence of a Maintenance Agreement time spent to redesign a site for compatibility due to the introduction of a new browser version will be separately negotiated and in addition to the base price of our agreement.

All notices shall be in writing and shall be made either by publication or via email. RGB Internet Systems Inc. may publish notices on this website (http://rgbeasyweb.com) to inform users of changes to the service, Terms of Use, or other important procedures; such postings shall constitute notice to users.
